Durch Zugriff oder Nutzung unserer mobilen App und des Treueprogramms (nachfolgend zusammenfassend „Dienste“ genannt), die von der Projekt Leipziger Platz Werbegemeinschaft GbR, c/o HGHI Immobilienverwaltung Verwaltung GmbH, Jägerstraße 49/50, 10117 Berlin („wir“oder „uns“) über unterschiedlichen Medien oder Geräte bereitgestellt werden, stimmen Sie diesen Nutzungsbedingungen („Nutzungsbedingungen“) zu und verpflichten sich zu deren Einhaltung.
Die Nutzungsbedingungen stellen eine rechtlich verbindliche Vereinbarung dar, die mittels Durchlaufens des vollständigen Vorgangs zur Kontoerstellung zustande kommt. Wenn Sie den Nutzungsbedingungen nicht zustimmen möchten, nehmen Sie bitte von der Nutzung der Dienste Abstand.
Die Teilnahme an unserem Treueprogramm ist kostenlos und bietet Ihnen Angebote, Werbeaktionen und Informationen über unser Treueprogramm gemäß der Beschreibung auf unserer Webseite. Zum Teilnehmen bei „MoB punktet“ installieren Sie zunächst die Mall of Berlin-App auf Ihrem Android-Handy oder Ihrem iPhone. Die Mall of Berlin-App gibt es im Google PlayStore und im Apple Appstore.
Innerhalb der App haben Sie die Möglichkeit, sich zu registrieren. Dazu gehen Sie innerhalb der Mall of Berlin-App unter dem Reiter „Mall of Berlin punktet“ unten rechts auf registrieren.
Um über unsere mobile App auf das Treueprogramm („MoB punktet“) zugreifen zu können, müssen Sie ein Konto bei „uns“ anlegen. Das Anlegen eines Kontos und die damit verbundene Übermittlung personenbezogener Daten ist freiwillig. Die Dienste sind für Nutzer ab dem Alter von sechzehn (16) Jahren vorgesehen.
Wenn Sie ein Konto bei „uns“erstellen, müssen Sie den Anmeldevorgang vollständig durchlaufen und abschließen. Dazu gehören die Angabe der benötigten Informationen (d.h. Vor- und Zuname, E-Mail-Adresse, Geburtsdatum, PLZ Ihres Wohnortes und Geschlecht) und das Festlegen eines Passwortes.
In jedem Fall verpflichten Sie sich, „uns“ korrekte und vollständige Daten zu übermitteln und Ihre Daten bei Bedarf zu aktualisieren. Pro Nutzer ist nur ein Konto im Rahmen des „MoB punktet“-Programms zulässig.
Sobald Ihr Konto erstellt wurde, nehmen Sie automatisch an „MoB punktet“ teil.
Sie bestätigen, dass „MoB punktet“ auf Sie persönlich ausgestellt ist, denn „MoB punktet“ ist Privatpersonen für deren persönliche, nicht geschäftliche Nutzung vorbehalten. Eine Nutzung zu gewerblichen Zwecken ist ausgeschlossen. Die Punkte sind nicht übertragbar und „MoB punktet“ ist kein Zahlungsmittel.
Sie bestätigen, dass „wir“ „MoB punktet“ jederzeit und ohne Angabe von Gründen ändern, aussetzen oder beenden können. Etwaige zum Zeitpunkt der Einstellung der Dienste bereits entstandene Ansprüche bleiben davon unberührt.
„Wir“ sind berechtigt, Sie von der Nutzung unserer Dienste auszuschließen, wenn Sie damit missbräuchlich umgehen, zum Beispiel wenn wir feststellen, dass Käufe nur zum Schein vorgenommen und wieder storniert werden, um für das Sammeln von Points relevante Umsätze vorzutäuschen.
Sie können jederzeit und ohne Angaben von Gründen die Nutzung „unserer“ Dienste einstellen.
Wir löschen Ihre Daten drei Monate, nachdem Sie den Vertrag über die Teilnahme an dem Mall of Berlin Punkte-Programm schriftlich, in Textform (per E-Mail) oder in der App gekündigt haben. Es gilt eine Kündigungsfrist von 2 Wochen.
Wenn Sie die Nutzung der Mall of Berlin punktet App eingestellt haben, Löschen wir Ihre Daten spätestens nach drei Jahren. Widerrufen Sie Ihre Einwilligung in die automatische Erfassung Ihres Standorts über Ihr Endgerät, erfassen wir Ihren Standort nicht mehr automatisch.
Sie verpflichten sich, „uns“ unverzüglich über eine unrechtmäßige Nutzung Ihres Kontos zum Zugriff auf die Dienste zu unterrichten.
Unter Umständen bieten „wir“ Hypertext-Links von den Diensten, die Sie über die Dienste erhalten, zu externen Webseiten oder Internetquellen an. „Wir“ überwachen die Inhalte externer Webseiten oder Internetquellen nicht.
Sie stimmen ausdrücklich zu, dass „wir“ weder für Informationen, Inhalte, Produkte, Dienstleistungen oder Materialien auf externen Webseiten oder Internetquellen verantwortlich oder haftbar sind, noch für angebliche oder tatsächliche Schäden, die aus dem Zugriff auf oder die Nutzung solcher Informationen, Inhalte, Produkte, Dienstleistungen oder Materialien auf externen Webseiten oder Internetquellen sind.

Das Eigentum und sämtliche Eigentumsrechte an Ihren Inhalten verbleiben bei Ihnen. Durch das Erstellen, Posten, Hochladen, die Eingabe, Übermittlung oder Bereitstellung Ihrer Inhalte über die Dienste gewähren Sie „uns“ und unseren verbundenen Unternehmen eine globale, gebührenfreie, nicht ausschließliche, unterlizenzierbare und übertragbare Lizenz, Ihre Inhalte über sämtliche Medien in Verbindung mit den Diensten und im rechtlich zulässigen Umfang zu nutzen, zu reproduzieren, abzubilden, öffentlich darzustellen, zu veröffentlichen, anzupassen, zu reformatieren, zu verwerten und zu übersetzen. Die Lizenz behält bis zum Ablauf eines Zeitraums von einem Jahr nach Schließung Ihres Kontos aus jedwedem Grund ihre Gültigkeit.
Die Servicefunktionen ermöglichen es Ihnen, Ihre Inhalte und Informationen über die Dienste zu teilen; dazu gehört das Teilen von Informationen über soziale Netzwerke. Sie sind und bleiben jedoch unter allen Umständen ausschließlich verantwortlich und haftbar für die Nutzung der Dienste und für Ihre gesamten Inhalte.
Sie verpflichten sich, Ihre Inhalte oder die Dienste nicht für unrechtmäßige oder unangemessene Zwecke zu nutzen. Hierzu gehören unter anderem:
„Wir“ überwachen Ihre Inhalte, die Sie über unsere Dienste veröffentlichen, nicht. „Wir“ behalten uns das Recht vor, übernehmen jedoch keine Verpflichtung, Ihre Inhalte zu überprüfen und nach unserem Ermessen Ihre Inhalte zu entfernen oder zu löschen, wenn sie nicht unseren Nutzungsbedingungen entsprechen. „Wir“ überwachen oder beschränken keine Kommunikation der Nutzer untereinander über die Dienste.
Sie bestätigen ausdrücklich, dass Sie bei Nutzung der Dienste eventuell Inhalte, Waren oder Dienstleistungen erhalten oder mit ihnen konfrontiert werden, die Sie unter Umständen für unangemessen, falsch, irreführend, verleumderisch, obszön oder anderweitig verurteilenswert halten. Sie sind ausschließlich dafür verantwortlich, die Vertraulichkeit Ihrer Passwörter und Kontoidentifikation zu sichern. „Wir“ haften nicht für Auswirkungen der Nutzung Ihres Kontos durch unberechtigte Dritte. Sie sind ebenfalls für sämtliche Aktivitäten auf Ihrem Konto verantwortlich. „Wir“ empfehlen Ihnen, ein sicheres Passwort festzulegen und es regelmäßig zu ändern, um das Risiko eines unrechtmäßigen Zugriffs auf Ihr Konto zu verringern.
Sie sind und bleiben unter allen Umständen ausschließlich verantwortlich für die Inhalte, die Sie über die Dienste übertragen, Ihre Nutzung der Dienste und sämtliche Aktivitäten auf Ihrem Konto. Sie sind demnach dafür verantwortlich, für ordnungsgemäße Konfiguration zu sorgen oder angemessene Schritte zu unternehmen, um die Sicherheit, den Schutz und die Sicherung Ihrer Inhalte gegen Angriffe aufrecht zu erhalten; dazu gehören Ihre eigenen Daten und/oder auf Ihrem Computer bzw. Ihrem Mobilgerät gespeicherte Software.
Sie verstehen und bestätigen, dass Sie über die Dienste nach eigenem Ermessen und auf eigenes Risiko auf Informationen, Materialien oder Daten zugreifen, sie herunterladen oder anderweitig erlangen und dass Sie die alleinige Verantwortung für Schäden an Ihrem Computersystem oder Datenverlust tragen, die aus dem Herunterladen solcher Informationen, Materialien oder Daten resultieren.
Sie müssen sämtliche Geräte (Computer, Mobilgeräte etc.), mit denen Sie auf die Dienste zugreifen und sie nutzen, unter Beachtung geltenden Rechts und geltender Vorschriften beschaffen, einschließlich, aber nicht beschränkt auf geistige Eigentumsrechte.
Die von „uns“ erbrachten Dienste dienen lediglich Informationszwecken. Obwohl „wir“ angemessene Bemühungen unternehmen, um sicherzustellen, dass die Inhalte der Dienste korrekt, vollständig und aktuell sind, werden die Dienste von „uns“ nach Verfügbarkeit und ohne Gewährleistung erbracht. Sie erklären ausdrücklich, dass Sie die Dienste auf eigenes Risiko nutzen.
Im rechtlich zulässigen Umfang lehnen „wir“ die Haftung für Schaden, Verlust oder andere Auswirkungen der Nutzung der Dienste oder ihrer Inhalte sowie für Ihre Inhalte, die Sie über die Dienste veröffentlichen und Ihnen gegenüber für indirekten Schaden und Verlust sowie ideelle Schäden, Schaden aus entgangenem Gewinn, Umsätzen, Nutzung oder Daten aus der Nutzung oder dem Betrieb der Dienste ab.
„Wir“ erklären ausdrücklich, dass (1) die Dienste nicht frei von Fehlern oder Viren sind, (2) die Verbindung zu den Diensten die üblichen Risiken von Verbindungen mit und Übertragungen im Internet und Mobilfunknetzwerken mit sich bringt, insbesondere in Bezug auf die Geschwindigkeit der Datenübertragung, Informationsanfrage oder Antwortzeiten auf Abfragen sowie technische Leistung, (3) „wir“ keine Kontrolle über externe Netzwerke oder Webseiten haben, auf die Sie während der Nutzung der Dienste zugreifen, (4) „wir“ für Datenverlust, Speicherfehler, falsche oder verspätete Lieferung von Daten oder Materialien über die Dienste keine Haftung übernehmen, und (5) „wir“ jegliche ausdrückliche oder implizierte Gewährleistung ablehnen, einschließlich Gewährleistung für die übliche / zufriedenstellende Qualität oder die Eignung der Inhalte und der Dienste.
Verschiedene Arten von Punkten und Punkte sammeln
Es gibt drei Arten von Punkten: Visitpoins, Shoppingpoints & Foodpoints
Visitpoints
Für jeden Besuch der Mall of Berlin erhalten Sie 10 Visitpoints pro Tag. Kommen Sie regelmäßig, erhalten Sie zusätzliche Visitpoints.
Um sich die Visitpoints gutschreiben zu lassen, scannen Sie die an den Eingängen und an den Info-Points angebrachten QR-Codes oder lassen Sie sich die Punkte automatisch gutschreiben, indem Sie ihr Bluetooth & die Ortungsdienste auf Ihrem Smartphone aktivieren. Die Signale unserer Bluetooth Sender an allen Haupteingängen der Mall of Berlin werden von der Mall of Berlin – App empfangen und die Punkte werden Ihrem Konto automatisch gutgeschrieben.

Nach dem siebten Folgetag, startet die Vergabe der Punkte automatisch wieder mit dem ersten Tag.
Wenn Sie sicher gehen möchten, dass die Visitpoints korrekt gutgeschrieben wurden, schauen Sie einfach in Ihrem Mitgliedsausweis in der App nach. Sollten hierbei Probleme entstehen, wenden Sie sich an einen unserer Info-Points.
Ab dem Status pink werden Ihnen keine Visitpoints mehr gutgeschrieben. Hier erfolgt die Kennzeichnung für Ihre Anwesenheit (mit einem Haken) in Ihrem Nutzerprofil.
Shoppingpoints
Für jeden Einkauf in der Mall of Berlin erhalten Sie Punkte im Wert Ihres Einkaufs. 1 Euro entspricht dabei einem Punkt.
Die Gutschrift erfolgt an unseren Info-Points. Legen Sie am Info-Point den Klassenbeleg vor, weisen sich mit Ihrem Mall of Berlin punktet-Mitgliedsausweis aus der Mall of Berlin-App aus und lassen Sie sich die Punkte auf ihrem Konto gutschreiben. Ihre Punkte sind nach kurzer Zeit in der App sichtbar.
Es werden Punkte vom Kaufbeleg gutgeschrieben, sofern der Kaufbeleg ausgehend vom Kaufdatum des Kassenbeleges nicht älter als 14 Tage ist. Kaufbelege die später als 14 Tage seit dem Kauf vorgelegt werden, können nicht mehr zur Erfassung von Shoppingpoints angenommen werden.
Die MitarbeiterInnen am Info-Point versehen den Kaufbeleg mit einem Kürzel bzw. einem Stempel, um eine Kennzeichnung der gutgeschriebenen Punkte vorzunehmen.
Foodpoints
Die Mall of Berlin punktet-Mitgliedschaft berechtigt Sie, ab Registrierung, sofort für einen 10%igen Preisnachlass auf Ihren Verzehr in unserem Foodcourt - ab einem Mindestverzehr von 4,00 €, bei allen teilnehmenden Restaurants.
Dazu zeigen Sie lediglich beim Bezahlen Ihre Foodcourt+ Karte innerhalb Ihrer App vor. Die Foodcourt+ Karte befindet sich in der App unter dem Punkt Foodcourt.
Zusätzlich erhalten Sie für jeden Verzehr in unserem Foodcourt 10 Punkte. Um sich die Punkte gutschreiben zu lassen, scannen Sie den QR-Code an der Kasse des jeweiligen gastronomischen Betriebes. Bitte beachten Sie hierbei, dass Ihnen Foodpoints lediglich einmal pro Tag gutgeschrieben werden.
Stornierung von Points
Bereits zu Ihren Gunsten verbuchte Points können wieder storniert werden, wenn Sie diese Nutzungsbedingungen vorsätzlich oder grob fahrlässig verletzten.
Welchen Status gibt es und wie viel Punkte werden benötigt, um den Status zu wechseln?
Mall of Berlin punktet bietet Ihnen 4 Statusstufen.
1) Weiß nach der Registrierung
2) Pink ab 1.000 Punkte
3) Gold ab 5.000 Punkte
4) Royal Shopper ab 10.000 Punkten.

Ab 1.000 Punkten wechseln Sie automatisch in den nächsten Status. Sie erkennen dies am Farbwechsel zu pink in Ihrem Nutzerprofil. Achten Sie darauf, dass ein Statuswechsel ab diesem Status ausschließlich über Ihre Shopping- sowie Foodpoints möglich ist. Visitpoints können weiterhin gesammelt werden, tragen jedoch nicht zur Erhöhung Ihrer Punktzahl bei.
Status gold
Ab 5.000 Punkten wechseln Sie automatisch in den Status gold. Sie erkennen dies am Farbwechsel zu gold in Ihrem Nutzerprofil.
Status Royal Shopper
Ab 10.000 Punkten wechseln Sie automatisch in den höchstmöglichen Status bei MoB punktet. Als Royal Shopper genießen Sie die maximalen Vorzüge unseres Treueprogramms. Die Farbe Ihres Nutzerprofils erscheint Ihnen jetzt in einem edlen Schwarz.
Als Royal Shopper genießen Sie die folgenden zusätzlichen Vorteile:
Vorbehaltlich Ihrer Zustimmung können Informationen über Ihren Standort innerhalb unseres Einkaufszentrums von „uns“ erhoben und verarbeitet werden, während Sie bei einer unserer mobilen Anwendungen angemeldet sind; damit werden die Häufigkeit und Dauer Ihrer Besuche und Ihre Bewegungen innerhalb des Einkaufszentrums gemessen. Auf Grundlage der Häufigkeit, Dauer und Bewegungen werden „wir“ Ihnen mit Ihrer Einwilligung Treuevorteile und Werbeinformationen zukommen lassen.
Bei der ersten Anmeldung Ihres Mobilgeräts bitten „wir“ Sie um Ihr Einverständnis, die Ortungsfunktion auf Ihrem Mobilgerät zu aktivieren. Wenn Sie der Aktivierung der Ortungsfunktion auf Ihrem Mobilgerät zustimmen, tritt dies sofort in Kraft und gilt für sämtliche Verbindungen in Ihren mobilen Anwendungen und für alle künftigen Besuche in unserem Einkaufszentrum. Sie können die Ortungsfunktion Ihres Mobilgeräts jederzeit über die Einstellungen Ihres Mobilgeräts deaktivieren.
Wenn Sie der Ortung Ihres Mobilgeräts und dem Teilen Ihres Standorts zustimmen, stimmen Sie der Verwendung und dem Teilen Ihres Standorts mit Dritten zu. Weitere Informationen entnehmen Sie bitte unserer Datenschutzrichtlinie.
Sie ermächtigen „uns“, Ihre Rechte und Pflichten gemäß diesen Nutzungsbedingungen auf Dritte zu übertragen, abzutreten oder zu delegieren.
Sollten Teile dieser Nutzungsbedingungen als ungültig, nichtig oder undurchsetzbar befunden werden, werden sie von den übrigen Teilen der Nutzungsbedingungen getrennt; diese behalten ihre volle Gültigkeit.
„Wir“ werden diese Nutzungsbedingungen von Zeit zu Zeit überarbeiten und womöglich jeweils mit Wirkung für die Zukunft ändern. Änderungen an diesen Nutzungsbedingungen werden bei Versand der überarbeiteten Nutzungsbedingungen über die Dienste wirksam. Participation in our loyalty programme is free of charge and provides you offers, promotions and information about our loyalty programme as described on our website. To participate in “MoB Scores”, first install the Mall of Berlin App on your Android phone or iPhone. The Mall of Berlin App is available in the Google PlayStore and the Apple Appstore.
Within the App, you have the possibility to register. To do so, go to “register” at the bottom right within the Mall of Berlin App under the tab “Mall of Berlin Scores”.
To access the loyalty programme (“MoB Scores”) via “our” mobile app, you need to create an account with “us”. The creation of an account and the associated transfer of personal data are voluntary. The Services are intended for users aged sixteen (16) and over.
When you create an account with “us”, you must complete and finalise the registration process. This includes providing the required information (i.e. first and last name, e-mail address, date of birth, postal code of your place of residence, and gender) and setting a password.
In any case, you undertake to provide “us” with correct and complete data and to update your data as necessary. Only one account per user is permitted within the scope of the “MoB Scores” programme.
As soon as your account is created, you will automatically participate in “MoB Scores”.
You confirm that “MoB Scores” is set up for you personally, because “MoB Scores” is reserved for private individuals for their personal, non-business use. Any use for commercial purposes is excluded. The points are not transferable and “MoB Scores” is not a means of payment.
You confirm that “we” may change, suspend or terminate “MoB Scores” at any time without providing any reasons. Any claims that may already have arisen at the time of the discontinuation of the Services shall not be prejudiced hereby.
“We” have the right to exclude you from using “our” Services if you misuse them, for example if we determine that purchases are being made and cancelled in order to fake sales to accumulate points.
You may stop using “our” Services at any time without providing any reasons.
We will delete your data three months after you have terminated the contract concerning participation in the MoB Scores programme in writing, in text form (by e-mail) or in the App. A notice period of two weeks shall apply.
After you have stopped using the Mall of Berlin App, we will delete your data within three years at the latest. If you revoke your consent to the automatic recording of your location via your end device, we will no longer record your location automatically.
You agree to notify “us” immediately of any unlawful use of your account to access the Services.
“We” may provide hypertext links from the Services to external websites or Internet sources. “We” do not monitor the content of external websites or internet sources.
You expressly agree that “we” are not responsible or liable for any information, content, products, services or materials on external websites or Internet sources, nor for any alleged or actual damage arising out of your access to or use of such information, content, products, services or materials on external websites or Internet sources.

The Services, which include all software used in connection with the Services, and all content (including but not limited to text, editorial content, databases, site design, operating system, photographs, images, pictures, graphics, videos, sounds, maps, logos, trademarks, information, and all portions thereof that comprise the Services) (collectively, the “Content”) are protected by applicable copyright, trademarks, service marks, patents and other intellectual property rights under applicable laws and are either owned, controlled or licensed by “us”.
“We” grant you a personal, non-exclusive, global, non-transferable, limited and revocable license to use the Services solely for personal use on one computer or mobile device for the duration of your use of the Services.
Except as otherwise provided in these Terms of Use, the Services and the Content may not be copied, reproduced, republished, posted, publicly displayed or performed, transmitted, adapted, translated, incorporated into other works, sold, transferred, sublicensed, reverse-engineered, deconstructed, or extracted or distributed in whole or in part in any other medium except as permitted by applicable law.
Failure to comply with this provision shall constitute a breach of contract and may result in civil or criminal penalties. “We” and “our” licensees reserve the right to take legal action against any breach of these provisions.
You may create, post, upload, input, transmit or make available through the Services information, text, editorial content, photographs, images, graphics, video, sound, messages, logos, trademarks and any other material you transmit, store or share as part of your use of the Services (collectively, “Your Content”).
You shall retain title and all proprietary rights to Your Content. By creating, posting, uploading, inputting, transmitting or making Your Content available through the Services, you grant “us” and “our” affiliates a global, royalty-free, non-exclusive, sublicensable and transferable license to use, reproduce, display, publicly perform, publish, adapt, reformat, exploit and translate Your Content through any and all media in connection with the Services, as permitted by law. The license shall remain in effect for a period of one year after your account is closed for any reason.
The service features allow you to share Your Content and information through the Services, including sharing information through social networks. However, you are and shall remain solely responsible and liable for your use of the Services and all of Your Content in all circumstances.
You agree not to use Your Content or the Services for any unlawful or improper purpose, including:
“We” do not monitor Your Content that you publish through “our” Services. “We” reserve the right, but assume no obligation, to review Your Content and, at “our” discretion, to remove or delete Your Content if it does not comply with “our” Terms of Use. “We” do not monitor or restrict communication between users through the Services.
You expressly acknowledge that by using the Services, you may receive or be exposed to content, goods or services that you may find inappropriate, false, misleading, defamatory, obscene or otherwise objectionable. As permitted by applicable law, you acknowledge that “we” are not liable for such content on the Services. Should you identify illegal content, please inform us of this.
Failure to comply with these Terms of Use may result in a warning and/or immediate suspension or closure of your account without notice; the right to take further action shall not be prejudiced thereby.
You are solely responsible for maintaining the confidentiality of your passwords and account identification. “We” are not liable for any effects of the use of your account by unauthorised third parties. You are also responsible for all activity on your account. “We” recommend that you set a secure password and change it regularly to reduce the risk of unauthorised access to your account.
You are and shall remain in all circumstances solely responsible for the Content you transmit through the Services, your use of the Services, and all activity on your account. It is therefore your responsibility to ensure proper configuration or to take reasonable steps to maintain the security, protection and safety of Your Content against attacks, including your own data and/or software stored on your computer or mobile device.
You understand and confirm that you shall access, download or otherwise obtain information, materials or data through the Services at your own discretion and risk and that you shall be solely responsible for any damage to your computer system or loss of data that results from the download of any such information, materials or data.
You must procure all devices (computers, mobile devices, etc.) with which you access and use the Services in compliance with applicable laws and regulations, including but not limited to intellectual property rights.
The Services provided by “us” are for information purposes only. Although “we” make reasonable efforts to ensure that the Content of the Services is accurate, complete and up to date, the Services are provided by “us” on an “as is” and “as available” basis. You expressly declare that you shall use the Services at your own risk.
To the fullest extent permitted by law, “we” disclaim liability for any damage, loss or other consequences of the use of the Services or their Content, as well as for Your Content posted by you through the Services and for indirect damage and loss in relation to you, as well as non-material damage, loss of profit, revenue, use or data arising from the use or operation of the Services.
“We” expressly declare that (1) the Services are not free of errors or viruses; (2) connection to the Services entails the usual risks of connection to and transmissions on the Internet and mobile networks, in particular with regard to the speed of data transmission, information requests or response times to queries and technical performance; (3) “we” have no control over external networks or websites which you access while using the Services; (4) “we” shall not be liable for any loss of data, storage errors, incorrect or delayed delivery of data or materials through the Services; and (5) “we” disclaim any express or implied warranties, including warranties of standard/satisfactory quality or fitness for purpose of the Content and the Services.
Collecting different types of points and credits
There are three types of points: Visit Points, Shopping Points and Food Points
Visit Points
For each visit to the Mall of Berlin, you will receive 10 Visit Points per day. If you come regularly, you will receive additional Visit Points.
To have your Visit Points credited, scan the QR codes at the entrances and Info Points or have the points credited automatically by activating your Bluetooth and location services on your smartphone. The signals of “our” Bluetooth transmitters at all main entrances of the Mall of Berlin will be received by the Mall of Berlin App and the points automatically credited to your account.

After 7 days in a row, the allocation of points automatically starts again as if it were the first day.
If you want to make sure that the Visit Points have been credited correctly, simply check your membership card in the App. Should problems arise in this connection, please contact one of “our” Info Points.
From the Pink status on, no more Visit Points will be credited to your account. Your presence will merely be marked (with a check) in your user profile.
Shopping Points
For every purchase in the Mall of Berlin, you will receive points in the value of your purchase, every EUR 1 corresponding to one point.
The credit will be issued at “our” Info Points. Present the receipt at the Info Point, identify yourself with your “MoB Scores” membership card from the Mall of Berlin App and have the points credited to your account. Your points will be visible in the App a short time later.
Points will be credited from the sales receipt provided the sales receipt is not older than 14 days from the date of purchase on the receipt. Purchase receipts submitted more than 14 days after the purchase cannot be accepted for the registration of Shopping Points.
The staff at the Info Point will mark the purchase receipt with a code or stamp to identify the points credited.
Food Points
“MoB Scores” membership entitles you to an immediate 10% discount on items you consume in “our” Foodcourt, starting at a minimum purchase of EUR 4.00, at all participating restaurants.
All you have to do is present your Foodcourt+ Card within your App when paying. The Foodcourt+ Card can be found in the App under the item “Foodcourt”.
In addition, you will receive 10 points for each item consumed in “our” Foodcourt. To have the points credited to your account, scan the QR code at the checkout of the respective food establishment. Please note that you will only be credited Food Points once a day.
Cancellation of points
Points already credited in your favour may be cancelled if you violate these Terms of Use intentionally or through gross negligence.
What are the various status levels and how many points are needed to change the level?
“MoB Scores” offers you four status levels:
1) White after registration
2) Pink as of 1,000 points
3) Gold as of 5,000 points
4) Royal Shopper as of 10,000 points
What benefits and advantages do I receive at each status level?
Status: White
Status: Pink
As of 1,000 points, you will automatically switch to the next status level. You can recognise this when the colour of your user profile changes to pink. Please note that a status change from this status level is only possible via your Shopping and Food Points. Visit Points can still be collected, but will not contribute to increasing your score.
Status: Gold
As of 5,000 points, you will automatically switch to Gold status. You can recognise this when the colour of your user profile changes to gold.
Status: Royal Shopper
As of 10,000 points, you will automatically switch to the highest possible status at “MoB Scores”. As a Royal Shopper, you will enjoy the maximum benefits of “our” loyalty programme. Your user profile will now appear in a noble black.
As a Royal Shopper, you will enjoy the following additional benefits:
Subject to your consent, information about your location within “our” shopping centre may be collected and processed by “us” while you are logged on to one of “our” mobile applications, measuring the frequency and duration of your visits and your movements within the shopping centre. Based on frequency, duration and movement, “we” will, with your consent, provide you with loyalty benefits and promotional information.
When you register your mobile device for the first time, “we” ask for your consent to activate the tracking feature on your mobile device. If you agree to activate the tracking feature on your mobile device, this will take effect immediately and will apply to all connections in your mobile applications and to all future visits to “our” shopping centre. You can deactivate the tracking feature of your mobile device at any time via the settings of your mobile device.
By agreeing to the tracking of your mobile device and sharing your location, you agree to use and share your location with third parties. For further information, please refer to “our” privacy policy.
You authorise “us” to transfer, assign or delegate your rights and duties under these Terms of Use to third parties.
If any part of these Terms of Use is found to be invalid, void or unenforceable, it shall be severed from the remaining parts of these Terms of Use, which shall remain in full force and effect.
“We” shall revise these Terms of Use from time to time and may change them from time to time with effect for the future. Any modifications of these Terms of Use shall be effective upon posting of the revised Terms of Use via the Services. If “we” make changes that “we” deem to be material and require your consent under applicable law, “we” shall notify you about the Services and, if applicable, seek your consent.
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
